机械设备暂时性进出口报关代理公司

（请相互尊重，切勿抄袭）第一条为了规范海关对暂时进出境货物的监管，根据《中华人民共H国海关法》（以下简称《海关法》）及有关法律、行政法规的规定，制定本办法。

第二条　经海关批准，暂时进出关境并且在规定的期限内复运出境、进境的货物适用本办法。

Chapter I General Provisions

Article 1 These Measures are formulated in accordance with the provisions of the Customs Law of the People's Republic of China (hereinafter referred to as the Customs Law) and other related laws and administrative regulations for the purpose of regulating Customs control over temporarily imported and exported goods.

Article 2 These Measures apply to goods that, with the approval of Customs, are temporarily imported or exported and, within the prescribed time limit, re-exported or re-imported.

第三条　本办法所称暂时进出境货物包括：

（一）在展览会、交易会、会议及类似活动中展示或者使用的货物；

（二）文化、体育交流活动中使用的表演、比赛用品；

（三）进行新闻报道或者摄制电影、电视节目使用的仪器、设备及用品；

（四）开展科研、教学、医疗活动使用的仪器、设备和用品；

（五）在本款第（一）项至第（四）项所列活动中使用的交通工具及特种车辆；

（六）货样；

（七）慈善活动使用的仪器、设备及用品；

（八）供安装、调试、检测、修理设备时使用的仪器及工具；

（九）盛装货物的容器；

（十）旅游用自驾交通工具及其用品；

（十一）工程施工中使用的设备、仪器及用品；

（十二）海关批准的其他暂时进出境货物。

使用货物暂准进口单证册（以下称ATA单证册）暂时进境的货物限于我国加入的有关货物暂准进口的国际公约中规定的货物。

Article 3  The term “temporarily imported and exported goods” in these Measures refers to:

(1) Goods for display or use at exhibitions, trade fairs, meetings or similar events;

(2) Items to be used for performance or competition in cultural activities or sports events;

(3) Instruments, e or articles for use in news coverage, film shooting or TV programming;

(4) Instruments, e or articles for use in scientific research, pedagogy or medical services;

(5) Means of transport and special-purpose vehicles for functions specified in Items (1) to (4) of this Article;

(6) Samples of goods;     

(7) Instruments, e or articles for use in charitable events;

(8) Instruments or tools for purposes of installation, adjustment, testing and maintenance of e;   

(9) Containers of goods;

(10) Means of transport and supplies for self-drive traveling purpose;

(11) E, instruments or articles for use in engineering and construction projects; and

(12) Other goods temporarily imported or exported as permitted by Customs.

Goods temporarily imported under ATA Carnets for the Temporary Admission of Goods (hereinafter referred to as ATA carnets) shall be limited to the goods as specified in the international conventions on temporary admission of goods to which the People's Republic of China is a contracting party.

没有一点点防备，就在上周五下班前，海关总署发布了新版《中华人民共H国海关暂时进出境货物管理办法》（海关总署第233号令，以下简称“办法”），该办法将于2018年2月1日起开始施行，原海关总署令第157号、212号同时废止。

解读：原规定中海关可以是隶属关、直属关、总署，现在直接规定超出范围的暂时进出境货物是总署批。即在新管理办法的第十条中，将暂时进出境货物超过6个月和18个月仍需延期的审批部门由“直属海关、海关总署”下放至“隶属海关、直属海关”。这将极大减少审批程序和时间，给企业带来便利。

新增：测试用产品、设备、车辆。

解读：在新管理办法的第三条中将暂时进出境货物的适用范围从12项增加至13项，其中增列（十二）测试用产品、设备、车辆。至于该项目的适用范围和控制条件，还要等总署的进一步解释。涉及的修改内容很多，对延期简化程序、取消前置审批、规范展览品审批等做出了具体规范，但笔者认为本次修改Z大的亮点就是明确了容器的含义，这样海关的执法统一性就有了保障，企业真正获得了改革的红利。
